Guidelines

The association Liberaux.org has created this website called Commerce21. Commerce21 is a virtual space devoted to idea-sharing and dialogue between people who have in common the values of libertarianism - free mind, free speech, free market. Commerce21 is a website that makes various features (general forums, restricted forums, calendar, and members’ pages) available to users.

The word “users” is a general term which includes visitors (who are not registered), registered users, regular users, members (registered users who pay their fee for membership), associate members, moderators, and administrators.

Users of this website must behave according to the general rules of conduct for Internet use. Given the fact that Liberaux.org is an association that must comply with the laws of France, all Commerce21 users must adhere to these laws when they publish any content on this website.

The administrator, a board member of Liberaux.org, has been delegated the responsibility to manage Commerce21, to maintain the safe and harmonious nature of the forum and prevent misconduct that may jeopardize the board’s liability.

The administrator may enlist individuals of his/her choice to aid in his/her affairs. These individuals, hereafter referred to as moderators, are dismissible at will.

The following charter defines the rules of conduct for this forum, which all users must abide by.


1. Any rights on the contents published on this website are yielded to Liberaux.org, and its moderators have the right to erase any content anytime without keeping any copy. Again, Commerce21 is not a general website, but a space devoted to libertarianism in its various nuances.
1.1. Any user who has been registered for less than 365 days, or whose message count is inferior to 500, may be put in the drudge user group or banned without warning. Any user in the drudge user group may be banned without warning.
1.2. For users who have been registered for more than 365 days, the procedure will be as follows:
1.2.1. If an moderator perceives that a user’s post is offending the general rules of conduct for Internet use, or the forum’s charter, the moderator reserves the right to request to the user to correct his/her behaviour.
1.2.2. If the user refuses, he/she will receive a warning. Warnings are issued by a moderator, under the supervision of the administrator.
1.2.3. Final exclusion of a user will happen immediately after 3 warnings.
1.2.4. A warning leads to a suspension proportional with the level of present warning. First warning: 1 week suspension; second warning: 1 month suspension; third warning: definitive exclusion from the website.
1.2.5. Moderators can give suspended warning. This suspended warning doesn’t come with any suspension penalty, the numbers of real warnings doesn’t go up but it is publicly explained that a real warning will be given in case of second offense. In case of second offense, penalty is automatically implemented.
1.2.6. Twice a year, in January and July, the board of Liberaux.org will consider personal requests for a pardon made by users regarding the acceptability of their behaviour deemed previously by a moderator as unacceptable. The board will consider these personal cases and may, or may not, find it appropriate to clear one or several warnings made against the user in question.
1.2.7. Being a member with up-to-date contribution doesn’t rule out the possibility of definitive exclusion of the forum.

2. Messages that are deemed undesirable will be erased immediately, at a moderator’s discretion, and a copy of the message will be kept by the moderator. Contributions containing any substantive message that is related to the following are liable to be evaluated as undesirable:
2.1. Attack on the private life of a member (an example of this includes, but is not limited to, the use of a personal quotation of a third party without his explicit agreement). Sending unrequested emails to Commerce21’s users is also prohibited;
2.2. Slander or abusive terms against a user. Slander does not include a description of precise facts. Slander includes, but is not limited to, the following examples:
2.2.8.1. The public evocation of an administrator’s or moderator’s work is prohibited, as well as messages asking for sanction of a user, messages approving or disapproving the decisions of the moderators, messages commenting on the actions of the moderators. In the same way, it is not appropriate to discuss the provisions of the charter within the forum, and doing so will not be tolerated by the moderators;
2.2.8.2. Regarding the previous two indents, these discussions are admissible in the part of the forum dedicated to members, pending the decision to allow it by the board by majority vote. During the general assembly, no censorship is permitted on the part of the forum which is dedicated to general assembly discussions, except on the topics dedicated to voting where all contributions that are not dealing with the voting procedure will be deleted by the moderators;
2.3. An unfounded act of libel against a user;
2.4. Incitement of offense and crime, provocation to suicide, discrimination, violence and hate, and/or racial discrimination;
2.5. Justification and apology of any crime, notably murder, rape, war crime and crime against humanity; the negation of crime against humanity;
2.6. Abuse of intellectual property of a third party;
2.7. Publishing commercial messages or messages from external origin;
2.8. Ideas denoting a sense of paranoia, and support of conspiracy or plot (an example of this includes, but is not limited to, the Zionist plot). Sexually explicit or pornographic contents will all not be deemed as acceptable content for this forum. This list is not exhaustive. Each moderator reserves the right to remove content deemed unacceptable by him/her immediately and without notice. These messages will lead to a warning if it is necessary.

3. Commerce21's users must use proper English language and grammar when writing their content. Nevertheless, Commerce21's moderation tolerates non-English words and locutions that describe a concept better than their English equivalent. Moderators reserve the right to evaluate and inform users on the quality of their communication (orthography, grammar, clarity of style, presentation, etc.) in order to keep the forum reader-friendly.

4. The following messages will be considered as relevant:
4.1. Informative contribution;
4.2. Initiation of an interesting debate;
4.3. Relevant and/or contradictory question.

5. There is no “right to reply” for any member whose content has been removed by a moderator.

6. Any attempt to avoid compliance with the provisions set forth in this charter and any attempt to manipulate the registration procedures of this website will face sanction by immediate exclusion. In particular:
6.1. Recurring and abusive use of expressions with an obvious aim to harm or offend a user of the forum will not be tolerated, and it is in the moderators’ attributions to warn violators.
6.2. Harassment of the moderators, in particular to request of warning or banishment of a user of the forum.
6.3. Recurring and excessive use of the “Report” function in order to be harmful to a user will not be tolerated and moderators are exhorted to remind the charter to wrongdoers.

7. Despite the vigilance of the moderators, who perform moderation a posteriori, if a message is discovered containing remarks that are deemed illegal under this charter or under the laws of France, Liberaux.org cannot be held liable for remarks made by its users. Liberaux.org invites the participants who discover potentially offensive content to notify the moderators so that the issue may be dealt with as soon as possible. References of each users are preserved by the website, including for non-registered users, and moderators have the right, when necessary, to transmit these data to competent authorities.
